YACHT CHARTER AGREEMENT AND CONTRACT

This contract summarizes and confirms the terms of a private charter of the sailing yacht Ventura, as agreed by the yacht’s management and the representative of the charter party.

Payment: If paying by credit card, the cardholder, who is the party signing this contract, hereby authorizes Atlantic Sail & Charter to charge the above fees to their card.

Rain date policy: Ventura is capable of sailing rain or shine, and offers sheltered cabin space for all guests. In the event of rain, all Ventura clients may postpone their sail and reschedule. A fee of $39 per person is charged for any charter rescheduled by the client. Clients wishing to reschedule due to rain must inform Atlantic Sail & Charter no later than 9:15 am on the day of the sail for any charter beginning no earlier than 6:00 pm. Clients wishing to reschedule any sail departing before 6:00 pm, must notify Atlantic Sail 24 hours in advance. The captain reserves the right to cancel any charter if he/she feels weather conditions represent a danger to the safety of the passengers. In such case, no reschedule fee will charged.

Cancellation Policy: If a charter is cancelled by the client more than four weeks before the scheduled sailing date, the charter party will receive a refund less the original deposit. If the charter party cancels their sail less than four weeks in advance of their date, all monies paid by the charter are forfeit unless Atlantic Sail & Charter books another charter on that date. If another charter party takes that date and time period, for an equal or greater amount of money, the original charter party will receive a full refund less 50% of the original deposit.
